I confirm that using a trademark which is protected by its registration with the enregistrement INPI without the owner’s permission constitutes infringement of trademark, an offence incriminated and punished by sections L.716-9 and L.716-10 of the intellectual property code. The counterfeit offence demands that the intent to commit an offence be proven. This element is the result of the professional using the trademark withut permission having had prior knowledge of the registration of the trademark. From then on, it would be desirable prior to any complaint being made to inform these restaurant owners of your rights regarding the Pierrade trademark.
Should you wish to take legal action against the restaurant owners concerned, I would ask you to refer to the the Local Directorate for Competition, Consumption and Fraud Protection of these companies’ headquarters
